Terms and Conditions

§1 GENERAL INFORMATION

(1) These General Terms and Conditions for Events (GTC) apply to all cycling events ("Event") organized by Popken GbR ("Organizer").

(2) By being incorporated through registration on the Event website, the GTC govern the contractual relationship between the contracting party and the Organizer ("Participation Agreement"). The "contracting party" and thus the contracting partner of the Organizer and entitled to assert claims against the Organizer, is exclusively the person who obtains the Event services via the respective Event website; this expressly applies even if the Event services include participation rights or other services for the benefit of third parties.

(3) An essential part of the participation agreement are the rules applicable to the respective event and available on the website ("PLATTFUSS CODEX"). The contractual partner hereby assures that they have read the respective valid regulations and, in the case of purchasing event services for third parties, have informed the affected persons in advance thereof.

(4) The contractual partner acknowledges that a mandatory prerequisite for participation in the organizer's events is the submission of a valid liability waiver for the respective event, which is available (unchanged) on the respective event website, including the acknowledgment of the applicable regulations contained therein. The contractual partner must ensure that the organizer receives original copies of the participation agreement, signed by all persons for whom the contractual partner obtains event services from the participation agreement, no later than at accreditation. Persons who have not submitted a liability waiver will not be admitted to the event, without this giving rise to any rights for the contractual partner.

5) The contractual partner guarantees that the personal data provided by them during registration is correct and complete and that the persons concerned are eligible to participate in accordance with the respective regulations.

Section 2 Event Service

(1) The contracting party guarantees that the personal data provided during registration is correct and complete and that the persons concerned are eligible to participate in accordance with the respective regulations. By registering on the respective event website, i.e. by concluding the participation agreement, the contracting party acquires the right for all persons named on the registration form to participate in the event in accordance with the current General Terms and Conditions and the applicable regulations, provided that the corresponding declarations of liability have been submitted.

(2) The respective event services are described on the respective event website. After registering on the event website, the contractual partner will receive a registration confirmation.

(3) The events are open-air events and are therefore subject to weather conditions (weather, etc.). The contracting party acknowledges that the organizer cannot always influence the conditions on site and reserves the right to make adjustments to the contractual services for legitimate reasons (e.g., route) while taking the participants' interests into account as best as possible.

(4) The services of the event are officially non-transferable. Only the persons named on the registration form are entitled to participate.

Event documents will only be issued upon presentation of the confirmation email (see § 3 (5)), the signed liability waiver, and an identity card or passport. If personal collection of the event documents is not possible, they may only be handed over to a person with written authorization. The event documents will not be sent by mail.

§ 3 Services Rendered, Payment Terms, and Confirmation of Participation

1) For the event services, the contracting party pays the service indicated during registration ("participation fee"). This also expressly applies to session fees that the contracting party collects for the third parties named in the registration.

(2) The session fees include statutory value-added tax.

(3) Payment of the session fee is made via PayPal® or Shopify Payments.

(4) After payment of all participation fees, the contracting party receives a confirmation from the organizer for each person registered by them. The confirmation serves as proof that the organizer has received the participation fees in full. The confirmation must be presented for accreditation at the event venue. Without the confirmation, persons will not be admitted to the event, and the contracting party will not acquire any rights as a result.

§ 4 Withdrawal and Refund

A cancellation with a subsequent refund is not possible under any circumstances. If a participant is unable to attend the event, it is possible to transfer the participation to another person (as described in § 2 (4)).
